Welcome to the Privacy Notice of FXWL Limited (“ABASK”). You might be viewing this through our website or mobile application (which we’ll collectively call ‘’Platform’’ in short).  

Our Privacy Notice is designed to make you aware of what data we are collecting, how and why we collect it.

We are registered with the UK supervisory authority, the Information Commissioner’s Office (“ICO”), in relation to our processing of Personal Data under registration number ZB309532.

We are committed to protecting the privacy and security of the Personal Data we process about you.

Controller

Unless we notify you otherwise, we are the controller of the Personal Data we process about you. This means that we decide what Personal Data to collect and how to process it.

2. The purpose of this Privacy Notice

The purpose of this Privacy Notice is to explain what Personal Data we collect about you and how we process it. This notice also explains your rights, so please read it carefully. If you have any questions, you can contact us using the information provided in the “How to contact us” section.

3. Who this Privacy Notice applies to

This Privacy Notice applies to you if:

  • You visit our website or platform.
  • You purchase goods or services from us.
  • You inquire about our products and/or services.
  • You sign up to receive newsletters and/or other promotional communications from us.
  • You send an email, SMS, WhatsApp message, phone, or online request to our customer service team or contact us via our social media channels.
  • You sign up for a trade account.

4. What Personal Data is

‘Personal Data’ means any information that can identify an individual, either directly or indirectly. For example, you can be identified by your name or an online identifier.

We take all reasonable and appropriate technical and organizational measures to protect the security of your personal information throughout the course of our business. Technical safeguards include, for example, restrictive access, encryption, antivirus software, and regular testing and evaluation.

If we transfer your information to a country outside the UK or the EEA, we have put in place contractual agreements or other appropriate measures with the recipients of your information to ensure that your Personal Data is equally protected.

5. The Personal Data we collect

The type of Personal Data we collect about you will depend on our relationship with you. We generally use your data to perform a contract we have entered into with you, or to take steps prior to entering into such a contract.

We currently collect and process the following information:

  • Personal identifiers (for example, name, surname, email address, postal address, and telephone number).
  • Contact details, including mobile telephone numbers where you have chosen to provide them (for example, to receive order updates, delivery notifications, or marketing text messages).
  • Consent preferences relating to SMS/text message communications, including records of when and how you provided consent.
  • Payment-related information (for example, credit/debit card details, billing address, and social security number).
  • Cookies (for more information on how we use cookies, see our Cookies Notice).
  • Usage data, including intended purchases, your marketing preferences, wishlists, and order history.
  • Business details if you apply for a trade account.

6. How we collect your Personal Data

We collect most of the Personal Data directly from you—in person, by telephone, text, or email, and via our website or platform. We collect your Personal Data directly from you when you:

  • Create and place an order on our platform.
  • Sign up to create an account or log in to your account on our platform.
  • Subscribe to our newsletters or mailing lists.
  • Participate in promotional activities.
  • Send an email, SMS, WhatsApp message, phone, or online request to our customer service team, or contact us via our social media channels.
  • Visit our platform.
  • Sign up for a trade account.
  • Opt in to receive SMS/text message updates or marketing communications by ticking a consent box, entering your number in an online form, or otherwise providing your explicit consent.
  • Correspond with us by text message (for example, replying to an order confirmation or support message).

However, we may also collect your Personal Data from third parties, such as:

  • Our service providers, in order to deliver the goods and services requested.
  • Other third parties outside ABASK, where you have agreed that they may share your information with us for marketing purposes.
  • Government, tax, or law enforcement agencies.

The performance of a contract

We use your Personal Data to perform a contract we have entered into with you, or to take steps prior to entering into such a contract. We collect and use your data only for the following purposes:

  • To provide you with goods, services, and information that you have requested from us by processing your transactional information for purchases and payments.
  • To provide you with customer service and support, handle enquiries, and update you on changes to your order or other services.
  • To communicate with you and contact you regarding your purchases and orders.
  • To allow you to use our platform.

Legitimate interest

We also use your data for the following purposes:

  • To manage, improve, and update our platform, and to ensure that content from our platform is presented to you in the most effective and optimal manner (please see our Cookie Notice for more information).
  • To personalize your experience on our platform and provide you with personalized advertising and marketing by processing Personal Data relating to your interactions (such as app usage, transactions, and platform visits).
  • To personalize communications and contact you—via email, telephone, social media, text message, WhatsApp, or postal mail—to inform you of account activity, delivery fulfillment, and marketing-related activity.
  • To customize, measure, and improve our services.
  • To offer you platform content that includes items and services you may like, and to keep track of your basket.
  • To use your browsing activity with ABASK to detect, diagnose, and resolve errors that occur on our platform.
  • To customize, measure, and improve our products and services.
  • To contact you directly for marketing and promotional purposes in connection with our business.
  • For research and development purposes.

In these cases, the legal basis on which we rely to lawfully process your data is the pursuit of our legitimate interests — for example, to better understand how users interact with our platform, resolve any issues they may have, or carry out direct marketing — where your interests and fundamental rights do not override those interests.

You can unsubscribe from marketing emails at any time by clicking the “unsubscribe” link at the bottom of any such email.

Legal obligation

We may use your information to:

  • Enable us to enforce our legal rights and/or to protect the rights, property, or safety of our employees and/or other third parties.
  • Prevent, detect, mitigate, and investigate fraud or other illegal activities.
  • Comply with legal obligations and requirements, for example, for tax purposes.

7. Purposes, lawful bases, and retention periods

We will only use your Personal Data when the law allows us to do so. Most commonly, we will use your Personal Data in the following circumstances:

i. Category of individual: Customer

Categories of Personal Data: Name, address, email address

Purpose of processing: Use of services, marketing purposes, performance of contract and measuring utilization.

Lawful basis: Contract, Consent, Legitimate Interests

Retention period: We will retain your information for no longer than is necessary for the purposes for which it was collected. Your information is securely stored on our servers or in external cloud systems managed by third-party providers. Once it is no longer required, we will securely dispose of your information by removing all files and backups from personal computers, OneDrive, and hard drives.

ii. Category of individual: Supplier/contractors

Categories of Personal Data: Business contact details

Purpose of processing: Performance of contract

Lawful basis: Contract

Retention period: We will retain your information for no longer than is necessary for the purposes for which it is intended. Your information is securely stored on our servers or in external cloud systems managed by third parties. We will then dispose of your information by removing all files and backups from personal computers, OneDrive, and hard drives.

iii. Category of individual: Customer (SMS subscriber)

Categories of Personal Data: Mobile telephone number, consent record

Purpose of processing: To send transactional messages (such as delivery updates) and/or marketing text messages where you have provided explicit consent.

Lawful basis: Contract (for service notifications) and Consent (for marketing texts)

Retention period: Retained for as long as your consent remains valid, or as necessary to provide the contracted services. Records of consent are maintained to demonstrate compliance.

Where Personal Data is processed because it is necessary for the performance of a contract to which you are a party, we will be unable to provide our services without this information.

8. Protecting your Personal Data

We take all reasonable and appropriate technical and organizational measures to protect the security of your personal information throughout the course of our business. Technical safeguards include, for example, restricted access, encryption, antivirus software, and regular testing and evaluation.

9. International Transfers

If we transfer your information to a country outside the UK or the EEA, we have put in place contractual agreements or other appropriate measures with the recipients of your information to ensure that your Personal Data is equally protected.

10. Your rights and how to complain

You have certain rights in relation to the processing of your Personal Data, including the following:

  • Right to be informed

You have the right to know what Personal Data we collect about you, how we use it, for what purpose and lawful basis, with whom we share it, and how long we keep it. We use this privacy notice to explain these details.

  • Right of access (commonly known as a “Subject Access Request”)

You have the right to receive a copy of the Personal Data we hold about you.

  • Right to rectification

You have the right to have any incomplete or inaccurate information we hold about you corrected.

  • Right to erasure (commonly known as the “right to be forgotten”)

You have the right to ask us to delete your Personal Data.

  • Right to object to processing

You have the right to object to us processing your Personal Data. If you object to us using your Personal Data for marketing purposes, we will stop sending you marketing materials.

  • Right to restrict processing

You have the right to request that we restrict the use of your Personal Data.

  • Right to portability

You have the right to ask us to transfer your Personal Data to another party.

  • Automated decision-making 

You have the right not to be subject to a decision based solely on automated processing that significantly affects you. We do not use automated decision-making.

  • Right to withdraw consent

If you have provided your consent for us to process your Personal Data for a specific purpose, you have the right to withdraw that consent at any time. Once withdrawn, we will no longer process your information for the purpose(s) you originally agreed to, unless we are permitted by law to do so. You can withdraw your consent at any time by contacting clientservice@abask.com.

If you have provided consent to receive SMS/text message marketing from us, you may withdraw that consent at any time. You can do this by clicking the unsubscribe link in each text message, or by contacting us at clientservice@abask.com.

Once you withdraw consent, we will no longer send you SMS marketing messages, although you may still receive essential service or transactional texts (for example, delivery updates) if these are necessary to perform our contract with you.

  • Right to lodge a complaint

You have the right to lodge a complaint with the relevant supervisory authority if you are concerned about the way in which we are handling your Personal Data.

  • How to exercise your rights

You will not usually need to pay a fee to exercise any of the above rights. However, we may charge a reasonable fee if your request is clearly unfounded or excessive. Alternatively, we may refuse to comply with your request in such circumstances.

If you wish to exercise your rights, you may contact us using the details set out below in the section titled “How to contact us and our Data Protection Officer.” We may need to request specific information from you to confirm your identity before we can process your request.

Once we have received this information, we will process your request without undue delay and within one month. In some cases, such as where requests are complex, we may need more time to respond. If this is the case, we will keep you informed of the progress.

11. Children's privacy

We do not offer our products or services to children, and we do not knowingly collect the Personal Data of children without parental consent, unless permitted by law.

If you are a child, you must have your parent’s permission to use our services. If you become aware that a child has provided us with their Personal Data without parental consent, please contact us as described below. Where appropriate, we will securely and permanently delete the data in accordance with applicable law.
